Official Plan
Planning processes monitors all new development in the Town and makes sure that the objectives of the Official Plan - which is a policy document setting out the future direction of the Town - are being met. The purpose of the Official Plan is to guide the physical development of the Town of Arnprior by articulating policies and land use designation that describe and promote the desired future form of the Town.                                     

Comprehensive Zoning By-law
Planning staff administer the Town’s Comprehensive Zoning By-law, 4990-01, as amended. If you are proposing to construct a new building or add to an existing structure, the zoning by-law contains the municipality’s zoning regulations. Planning staff can assist you in interpreting the zoning by-law and advise you as to whether the proposed use and location is in compliance with the approved zoning for your property. Information contained in the zoning by-law can also be of assistance to you should you intend to purchase a new property, as it sets out the permitted uses of the property you are proposing to purchase. Staff can assist in reviewing the zone provisions to determine whether you may require a rezoning to permit an intended use.  Schedule A to By-law 4990-01

 

The municipality does not issue business licences for all types of business, but wishes to ensure that the land from which you intend to operate your business is zoned properly for the proposed use and that your business is conducted in compliance with the approved zone provisions applicable to your land. The by-law contains specific provisions with regard to commercial and industrial properties, as well as home occupation type uses.

Site Plan Control
The Planning Act of Ontario grants municipalities the authority to review and approve site plans for certain types of development in accordance with established municipal requirements. Site Plan Control Review, an integral component of the municipal planning and development review process, focuses on the technical issues of site design rather than land use. In Arnprior, commercial, industrial, institutional and medium and high density housing projects are subject to site plan control. Planning staff administer the site plan control by-law and are available for pre-consultation with applicants. Applications for site plan approval should be submitted to planning staff.

Minor Variance  

The Committee of Adjustment is appointed by Council to deal with minor problems in meeting municipal zoning by-law provisions. Members currently appointed to this committee are Murray Chown, Ken DeLuca, J. David Moore, Peter Pelletier and Carol Ruddy. Obtaining a minor variance involves an application to the Committee of Adjustment by submission of an application and appropriate fee, followed by a public hearing, full consideration of the proposal, and a decision rendered. Once the 20 day appeal period has expired, the committee’s decision is binding. A minor variance does not change the existing by-law, but rather provides relief from specific requirements of the by-law to suit special circumstances, for a site-specific property.

Consent

The Committee of Adjustment also deals with requests for consent. Consent, or severance, means the authorized separation of a piece of land to form two new adjoining properties, when a registered plan of subdivision is not considered necessary for the proper and orderly development of a municipality. In addition to the division of land, rights-of-way, easements and any change to you existing property boundaries also require land severance approval. The process to obtain a consent is very similar to the process to obtain a minor variance. Once the committee’s decision is final, there are usually conditions to fulfill, including requirements for road widening, rezoning or surveying. When all the conditions have been met by the applicant, a certificate is issued by the authority, and the severance goes into effect.

Planning staff are available to review the Official Plan policies and zoning by-law provisions which will affect applications for variance or consent and to provide the necessary application forms.

Frequently Asked Questions:

Why does a zoning by-law amendment take 2 to 3 months to process? The timing for processing a zoning by-law amendment, or any other planning application, is regulated by the Planning Act of Ontario, which sets out the steps which must be followed. Public consultation plays an important part in the review and approval of all types of applications and, therefore, the process is designed to ensure that the public are given the opportunity to review the proposal and provide comments to Council. The process requires 20 days notice of public meetings and 20 days of appeal period.
What is a "non-conforming use"? A "non-conforming use" is any use, existing on the date of the final passing of the zoning by-law, which is not listed as a permitted use in the zone where it is located.
